TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (hereinafter – the Terms) set out the rights, obligations, and responsibilities of the Buyer and the Seller when purchasing goods from the Red Tuxedo Ceramics online store. Before placing an order, the Buyer must read these Terms and confirm their acceptance.

1. General provisions

1.2. Buyer – a natural or legal person purchasing goods from the online store www.redtuxedoceramics.com.

1.3. These Terms apply to all orders placed in the online store. By placing an order, the Buyer confirms that they have read and agree to these Terms.

2. Conclusion of the purchase–sale contract

2.1. A purchase–sale contract between the Buyer and the Seller is deemed concluded at the moment when the Buyer forms a shopping cart, provides delivery details, selects a payment method, reviews these Terms, and clicks the “Pay” button.

2.2. The contract remains valid until all obligations of both parties are fully fulfilled.

2.3. If the Buyer does not agree with these Terms or any part thereof, they must not place an order in the online store.

3. Seller’s rights

3.1. The Seller has the right to temporarily or permanently suspend the operation of the online store without prior notice. In such cases, orders placed before the suspension will be fulfilled or the full amount paid will be refunded to the Buyer, who will be informed using the contact details provided.

3.2. The Seller has the right to unilaterally amend these Terms. The amended Terms take effect from the moment they are published on the online store and apply to orders placed after their publication.

3.3. The Seller has the right to cancel the Buyer’s order if, due to objective reasons (e.g., lack of stock), it cannot be fulfilled. In such cases, the full amount paid will be refunded to the Buyer.

4. Seller’s obligations

4.1. The Seller undertakes to make reasonable efforts to ensure the proper functioning of the online store but does not guarantee uninterrupted operation.

4.2. The Seller undertakes to deliver the goods within 1–5 business days from order confirmation, except in cases where the goods are temporarily out of stock. The Buyer will be informed separately of any changes to the delivery timeframe.

4.3. The Seller undertakes to process the Buyer’s personal data in accordance with applicable laws and the Privacy Policy.

5. Buyer’s rights

5.1. The Buyer has the right to purchase goods from the online store in accordance with these Terms and applicable laws.

5.2. The Buyer (consumer) has the right to withdraw from a distance purchase–sale contract within 14 calendar days from the date of receipt of the goods by notifying the Seller in writing.

5.3. The right of withdrawal does not apply to:

• goods made according to the Buyer’s individual order;

• goods clearly personalized to the Buyer’s needs (e.g., with custom text, inscription, or design).

5.4. Returned goods must be unused, undamaged, retain their original appearance, and be returned in their original packaging. Detailed return conditions are provided in the Refund Policy.

6. Buyer’s obligations

6.1. The Buyer must pay for the goods and delivery on time and accept the ordered goods.

6.2. Order processing begins once payment confirmation is received from the bank. If payment is not confirmed within 24 hours, the purchase–sale contract is considered not concluded.

6.3. The Buyer is responsible for the accuracy of the information provided.

7. Delivery of goods

7.1. Delivery conditions, terms, and costs are specified in the Shipping Policy.

8. Returns

8.1. The procedure for returning goods and issuing refunds is described in the Refund Policy, which forms an integral part of these Terms.

9. Liability

9.1. The Buyer is responsible for the accuracy of the personal data provided and any consequences arising from incorrect information.

9.2. The Seller makes reasonable efforts to ensure that product colors and appearance are displayed as accurately as possible but cannot guarantee that the Buyer’s device screen will accurately reflect the actual colors or textures of the goods.

9.3. The Seller is not responsible for information provided on third-party websites, even if the Buyer accesses them via links in the online store.

9.4. The parties are liable to each other for violations of these Terms in accordance with the laws of the Republic of Lithuania.

10. Communication

10.1. Notifications related to order processing are sent to the Buyer’s provided email address.

11. Final Provisions

11.1. All information provided in the online store shall be deemed to have been provided to the Buyer in written form.

11.2. Any disputes shall be resolved through negotiations, and if no agreement is reached, in accordance with the laws of the Republic of Lithuania.

11.3. The Buyer’s personal data shall be processed in accordance with the Privacy Policy.
